PRAIRIE FUNK TERMS AND CONDITIONS

PRAIRIE FUNK RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT

WARNING: READ BEFORE PURCHASING A TICKET OR ENTERING THE PROPERTY
BY PURCHASING A TICKET, ENTERING THE PROPERTY, OR PARTICIPATING IN PRAIRIE FUNK, YOU ARE GIVING UP IMPORTANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. YOU ASSUME ALL RISKS OF INJURY, DEATH, OR PROPERTY DAMAGE. PLEASE READ CAREFULLY.

This agreement is made in favor of Shaun Funk (the “Host”), including all owners, family members, volunteers, contractors, suppliers, contributors, artists, vendors, license holders, service providers, security, medical staff, directors, officers, representatives, successors, and assigns associated with Prairie Funk and the property located at 56111 Range Rd 65, Lac Ste. Anne County, Alberta (the “Property”).

 

DEFINITION OF PRAIRIE FUNK AND SCOPE OF ACTIVITIES

For the purposes of this agreement, “Prairie Funk” includes, without limitation, the entire duration of the event and all activities, actions, and circumstances related to attendance, whether planned or unplanned, including but not limited to:

  • Entry to and exit from the Property

  • Ticketing, check-in, camping, parking, walking, standing, dancing

  • Volunteering, working, performing, staging, setup, and teardown

  • Use of amenities, common areas, access roads, pathways, lakefront areas, viewing areas

  • All ancillary or incidental activities occurring on or near the Property

Prairie Funk further includes any travel to, from, or within the Property and any off-site areas designated or used for parking, access, transportation, or event-related purposes. All risks, waivers, releases, and indemnities contained in this agreement apply equally to all such activities and locations, whether occurring during scheduled programming hours or at any other time while present in connection with Prairie Funk.

 

1. AGE REQUIREMENT – NO MINORS

Prairie Funk is a strictly adult event. No minors (under 18) are permitted on the Property at any time, including children, infants, or dependents, regardless of supervision. Attendees must present government-issued ID upon entry. Any underage person will be denied entry or removed without refund.

 

2. TICKETS, REFUNDS, AND FORCE MAJEURE

  • Final Sale: All tickets and passes are non-refundable and non-transferable. Lost tickets will not be replaced.

  • Force Majeure: The Host will not issue refunds for any reason, including if the event is terminated early or cancelled due to Force Majeure, which includes but is not limited to extreme weather, wildfire or smoke, acts of nature, "Acts of God," acts of terrorism, government regulation, public health crises, or infectious disease.

  • Revocable License: Tickets are a revocable license and may be revoked at any time for safety, conduct, or legal reasons without compensation.

  • Programming: The Host reserves the right to change programming, schedules, or layout without notification or compensation.

 

3. ENTRY, SEARCHES, AND RE-ENTRY

  • Consent to Search: Entry is conditional upon personal and vehicle searches. Prohibited items (see Section 11) will be seized and not returned.

  • Re-Entry: Guests are permitted one (1) free re-entry per day, strictly during posted gate hours. The Host is not responsible for denied entry outside of these times.

  • Right of Refusal: The Host may refuse entry or evict attendees for unsafe, illegal, or disrespectful behavior without refund.

 

4. VEHICLE PARKING, RELOCATION, AND CONSENT

  • All vehicles brought onto or associated with the Property are parked at the owner’s risk. By entering the Property or parking a vehicle in connection with Prairie Funk, attendees expressly consent to the movement, relocation, towing, or repositioning of their vehicle by the Host, event staff, contractors, or authorized agents when reasonably necessary for safety, emergency access, traffic flow, fire prevention, or operational needs.

  • Clear and detailed parking information, including designated parking areas, access routes, fire lanes, and restricted zones, will be provided upon entry. Attendees agree to comply with all posted signage and directions given by staff at all times.

  • Attendees waive any and all claims against the Host for loss, theft, or damage to vehicles or contents arising from or related to parking or vehicle movement or relocation, except where such loss or damage is caused by the gross negligence or willful misconduct of the Host.

  • The Host assumes no responsibility for vehicles parked in unauthorized areas, on access roads, fire lanes, emergency routes, or neighboring properties. Vehicles parked in violation of posted instructions or staff direction may be relocated or removed without notice or compensation.

 

5. ALCOHOL AND SUBSTANCE POLICY

Prairie Funk includes a licensed bar operating in designated festival areas in accordance with applicable Alberta liquor laws and permit requirements.

Alcohol Service and Consumption

  • All alcohol available on the Property must be purchased from the licensed bar.

  • Alcohol purchased from the licensed bar may be consumed only within authorized areas and during permitted hours.

  • Attendees are not permitted to bring, possess, or consume personal alcohol anywhere on the Property, including camping areas, parking areas, and all festival spaces.

  • This is a no BYOB event.

  • Glass containers are strictly prohibited at all times.

  • Attendance at Prairie Funk may involve the consumption of alcohol or other substances.

  • Any decision to consume alcohol, cannabis, or other substances is made voluntarily and entirely at the attendee’s own risk.

  • Attendees expressly assume all risks associated with intoxication or impairment, including injury, illness, property damage, death, or harm to themselves or others.

  • Except as expressly required by applicable liquor laws, the Host does not assume a duty to supervise, monitor, or control individual alcohol consumption, intoxication levels, or personal decision making.

  • Attendees remain solely responsible for their conduct, compliance with all laws, and the consequences of their actions while impaired.

  • Bartenders and bar staff are authorized and required to refuse service to any person who is intoxicated, appears intoxicated, or is otherwise prohibited from being served under applicable liquor laws.

  • Refusal of service is final and does not create any duty, liability, or responsibility on the part of the Host or bar staff to monitor, detain, supervise, or protect the individual beyond what is required by law.

  • Illegal drugs and controlled substances are strictly prohibited on the Property.

  • Prescription medications must be for personal use only and properly labeled with the attendee’s name.

  • Operating any vehicle, machinery, or equipment while impaired is strictly prohibited.

  • If an attendee is reasonably believed to be impaired and unfit to operate a vehicle, the Host may restrict departure, relocate vehicles, or contact authorities for safety reasons.

  • The Host assumes no responsibility or liability for decisions made by attendees while impaired.

 

6. FIRE SAFETY, SMOKING, AND ENVIRONMENT

  • Wildfire Risk: The Property is in a rural area with extreme wildfire risk. Fire safety is an absolute priority.

  • Designated Smoking: Smoking, vaping, or cannabis is permitted ONLY within designated cleared areas. Materials must be extinguished in non-combustible receptacles.

  • Open Flame Ban: No open flames (campfires, candles, fireworks, flares, etc.) are permitted. Violators face immediate eviction and potential legal liability for damages.

  • Environment: Attendees must use designated bins and refrain from littering or contaminating the natural landscape.

 

7. RESTRICTED AREAS AND NEIGHBORING PROPERTIES

  • Restricted Zones: Entry into forests, woods, or undeveloped treed areas is prohibited due to hazards (dead trees, wildlife, uneven terrain).

  • Trespassing: Trespassing onto neighboring properties is strictly prohibited and may be reported under the Alberta Trespass to Premises Act.

 

8. WATERFRONT AND LAKE SAFETY

Prairie Funk includes approximately 700 feet of lakefront on the Property. No lifeguards or water safety personnel are on duty. Attendees are strictly prohibited from swimming, wading, or entering the water unless expressly authorized by the Host for a specific activity.

Any access to the lake or waterfront areas is entirely at the attendee’s own risk. The Host does not monitor, supervise, or provide safety oversight for any water-related activity. Attendees assume all risks associated with water access, including but not limited to drowning, injury, slips, falls, or exposure to wildlife or environmental hazards.

The Host may restrict or close access to the lake or waterfront areas at any time, for any reason, including safety, environmental conditions, or operational requirements. Compliance with all posted signage, instructions from staff, or other directions regarding the waterfront is mandatory. Failure to comply may result in immediate removal from the Property without refund.

 

9. HEALTH, SENSORY, AND INFECTIOUS DISEASE

  • COVID-19 & Illness: Attendees assume all risks related to exposure to communicable diseases or infectious illnesses (including COVID-19). The Host will operate in accordance with local health guidelines but is not liable for any illness contracted.

  • Sensory Exposure: Attendees assume all risk of hearing damage or sensory discomfort from amplified music and lighting effects.

 

10. FIRST-AID, MEDICAL EMERGENCIES, AND HARM REDUCTION

  • On-Site First Aid: For minor injuries, non-emergency first-aid is available at the designated security vehicles stationed on-site.

  • Emergencies: In the event of a serious medical emergency, attendees (or witnesses) must dial 9-1-1 immediately and notify festival staff or security so they can guide emergency vehicles to the location.

  • Authorized Medical Treatment and Transport: By entering the Property, attendees authorize the Host, staff, security, and authorized contractors to secure medical treatment, transport, or evacuation on their behalf in the event of injury, illness, or incapacitation. This authorization includes, without limitation, consenting to medical evaluation, procedures, and treatment decisions if the attendee is unconscious, incapacitated, or otherwise unable to provide consent, and acknowledging that it may not be possible to contact a next of kin or legal guardian prior to treatment.

  • Assumption of Risk: Attendees assume all risks associated with medical treatment, transport, or evacuation, including injuries related to music equipment, electrical cables, generators, or other on-site hazards. The Host is not responsible for any injury, illness, or accidents that occur during first-aid treatment, emergency response, or transport. Attendees are solely responsible for all associated costs, including but not limited to ambulance, air evacuation, or hospital fees.

  • Reporting: Attendees have a responsibility to report any hazards, injuries, or unsafe conditions to staff immediately.

  • Third-Party Medical Contractors: All emergency response personnel and third-party medical contractors are independent; the Host shall not be held liable for any accident, injury, or loss of life that may occur during medical intervention, treatment, or transport.

 

11. THIRD-PARTY CONTRACTOR LIABILITY

Attendees acknowledge and agree that all contractors, vendors, performers, security personnel, medical staff, and other third-party service providers engaged for Prairie Funk are independent and operate under their own authority. The Host does not select, supervise, or control the actions, qualifications, or performance of these third-party providers beyond what is required by applicable law.

The Host shall not be held liable for any injury, loss, damage, or claim arising from the actions, omissions, negligence, or misconduct of any third-party contractor, vendor, performer, or service provider, including but not limited to medical personnel, security staff, artists, or volunteers.

Attendees expressly assume all risks associated with interactions with third-party contractors and release, waive, and indemnify the Host from any claims, costs, or liability resulting from the acts or omissions of third-party service providers.

 

12. PROHIBITED ITEMS

The following are banned:

  • Glass

  • Personal alcohol

  • Fireworks

  • Flares

  • Open flames

  • Campfires

  • Candles

  • Bouncy castles

  • Illegal substances

  • Weapons

  • Laser pointers

  • Drones

  • Unauthorized sound systems

  • Pets (excluding pre-registered service animals)

 

13. CODE OF CONDUCT

Zero tolerance for:

  • Harassment

  • Discrimination

  • Violence

  • Sexual misconduct

  • Predatory behavior

Violations result in immediate removal and reporting to law enforcement.

 

14. DATA AND PRIVACY

By purchasing a ticket, you acknowledge that the Host collects personal data (name, email, etc.) for registration, communication, and analytics. Reasonable measures are taken to protect this data. Data may be shared with service providers (payment processors/marketing) but will not be rented or sold to third parties for independent benefit.

 

15. PHOTOGRAPHY AND MEDIA RELEASE

You consent to the use of your image, voice, and likeness in photos or video captured at the event for promotional or commercial purposes worldwide, in perpetuity, without compensation.

 

16. PERSONAL PROPERTY AND BELONGINGS

Attendees acknowledge that all personal property, including but not limited to vehicles, camping equipment, electronics, clothing, instruments, and valuables, brought onto or left on the Property is done so at the attendee’s sole risk.

The Host assumes no responsibility or liability for loss, theft, damage, or destruction of personal property for any reason, including but not limited to accidents, fire, weather, wildlife, other attendees, or acts of third parties.

Attendees expressly assume all risks associated with the care, storage, and use of personal property while on the Property or in connection with Prairie Funk. By entering the Property, attendees release, waive, and indemnify the Host from any claims, costs, or damages related to loss, theft, or damage of personal property, except where such loss or damage is caused by the gross negligence or willful misconduct of the Host.

Attendees are encouraged to secure all valuables, supervise personal items, and follow any posted guidance regarding property storage, camping safety, or restricted areas.

 

17. ASSUMPTION OF RISKS

I voluntarily assume all risks associated with Prairie Funk, whether occurring on the Property or during travel beyond the Premises during the event, including but not limited to:

  • Uneven ground

  • Falling trees

  • Wildlife

  • Extreme weather

  • Fire

  • Crowds

  • Water hazards

  • Actions of other attendees

 

18. RELEASE OF LIABILITY, WAIVER, AND INDEMNITY

To the fullest extent permitted by Alberta law:

  • Release: I release and discharge the Host from any and all claims, injury, death, loss, or damage, including those caused by negligence or breach of duty under the Alberta Occupiers’ Liability Act, arising from my participation in or presence at Prairie Funk.

  • Indemnity: I agree to hold harmless and indemnify the Host from any and all claims, damages, costs, or legal fees arising from my actions, conduct, or breach of this agreement. This indemnity explicitly includes, without limitation, claims arising from or relating to any guests, invitees, companions, or other persons present on the Property at my invitation or under my supervision, and any third parties with whom I interact in connection with Prairie Funk, including damage to neighboring properties, injury to other attendees, or harm to third parties.

  • Scope: This release and indemnity applies to my heirs, executors, representatives, and assigns, and extends to all claims arising directly or indirectly from my presence, participation, or activities at Prairie Funk, whether occurring on the Property or during travel to or from the event.

 

19. CLASS ACTION WAIVER AND DISPUTE RESOLUTION

By entering the Property or participating in Prairie Funk, attendees agree that any claims, disputes, or legal actions arising under this agreement or relating to the event must be brought individually and not as a class, collective, or representative action. Attendees expressly waive the right to participate in any class, collective, or representative proceeding against the Host or any associated party.

All disputes shall be governed by the laws of Alberta and resolved exclusively in the courts of Alberta. Attendees consent to the exclusive jurisdiction of Alberta courts for any legal proceedings relating to this agreement or Prairie Funk.

 

20. SEVERABILITY AND SURVIVAL

If any provision of this agreement is found to be invalid, unenforceable, or prohibited by law, the remaining provisions shall remain in full force and effect.

The releases, waivers, and indemnities contained in this agreement shall survive the conclusion of Prairie Funk, the expiration of tickets, removal from the Property, or any other termination of attendance. These provisions shall remain binding on the attendee, their heirs, executors, representatives, and assigns.

 

21. GOVERNING LAW

This agreement is governed by the laws of Alberta. Any disputes must be resolved in Alberta courts. If any provision is found unenforceable, the remaining provisions remain in full force.

 

22. CONFIRMATION

BY PURCHASING A TICKET OR ENTERING THE PROPERTY, I CONFIRM THAT:

  • I am 18 years of age or older

  • I have read and understood this agreement

  • I knowingly waive my legal rights
